1. Formation of Reservation Contract
A reservation contract is formed when:
- the guest completes the booking process, and
- a confirmation screen and/or confirmation email is issued.
The reservation details, including cancellation conditions displayed at checkout, form part of the binding contract.
2. Prices and Payment
All prices are displayed in Japanese Yen (JPY).
Payment is processed at the time of booking through Stripe or other methods displayed at checkout.
We do not store full credit card numbers.
If payment authorization fails or is later reversed, we reserve the right to cancel the reservation.
3. Cancellation and No-Show Policy
Cancellation fees vary by rate plan and are clearly displayed before booking confirmation.
By completing a reservation, the guest agrees to the cancellation policy shown at checkout.
No-show policy: Failure to arrive without prior cancellation (no-show) will result in a charge of 100% of the total reservation amount.
Refund timing depends on the payment provider.
4. Voucher Terms
The following applies to all prepaid or promotional vouchers:
- A voucher code is issued electronically to the email address entered at checkout.
- Vouchers are refundable only before issuance.
- Once a voucher code has been generated and emailed, it is non-refundable except where required by law.
- Voucher stays must be used on consecutive dates and may not be split.
- Extra beds or additional breakfast may incur additional charges payable on-site.
- Vouchers cannot be exchanged for cash.
- Voucher redemption is subject to availability.
- Vouchers may be used for any date available for paid booking on our website. Voucher use will not be restricted solely due to peak season.
- Upon redemption, confirmation will be sent to the same email address used for purchase.
5. Guest Conduct
We may refuse accommodation or terminate a stay if a guest:
- violates Japanese law,
- engages in threatening, abusive, or disruptive behavior,
- causes damage to property,
- disturbs other guests, or
- violates posted house rules.
In such cases, refunds will not be issued unless required by law.
6. Smoking Policy
Umi-no-Tonari is a non-smoking property unless designated areas are provided.
Smoking inside guest rooms or prohibited areas will result in:
- a special cleaning fee of ¥40,000, and
- additional compensation for room downtime, deodorization, or damage where applicable.
7. Limitation of Liability
To the maximum extent permitted under Japanese law:
- Our liability arising from accommodation contracts shall be limited to the total accommodation charges received for the relevant stay.
- We shall not be liable for indirect, incidental, special, or consequential damages, including lost profits or travel expenses, except in cases of willful misconduct or gross negligence.
- We are not liable for failure or delay caused by force majeure events, including natural disasters, pandemics, government action, power outages, or network failures.
- Nothing in these Terms excludes liability where such exclusion is prohibited by Japanese law.
8. Payment Disputes and Chargebacks
By completing a reservation or voucher purchase through this website, the guest confirms that:
- they are authorized to use the selected payment method,
- the payment is made voluntarily and in accordance with the displayed terms, and
- the reservation confirmation constitutes evidence of a valid and authorized transaction.
If a guest initiates a chargeback or payment dispute without valid legal grounds, we reserve the right to:
- recover the full amount owed,
- recover any chargeback fees or administrative costs imposed by the payment processor, and
- refuse future reservations.
Initiating a chargeback after accommodation services have been provided, or after voucher issuance or redemption, may constitute a breach of contract.
Nothing in this section limits rights granted under Japanese consumer protection laws.
9. Check-In, Check-Out and Financial Responsibility
Standard check-in time is from 15:00.
Standard check-out time is until 11:00.
Early check-in or late check-out may be available upon request and may incur additional charges.
The person making the reservation shall be responsible for all charges incurred by the guests included in the reservation. Where multiple guests occupy a room, each adult guest may be held jointly responsible for payment of all charges related to the stay.
Regardless of any payment arrangements or third-party billing instructions, the guest remains personally liable for all charges incurred during their stay unless expressly agreed in writing by the Hotel.
Guests are responsible for any loss or damage to rooms, facilities, or equipment caused by themselves or by persons accompanying them. The Hotel reserves the right to charge the cost of repair, replacement, special cleaning, or business interruption where applicable.
The Hotel shall not be liable for loss, theft, or damage to personal belongings left in guest rooms except in cases of willful misconduct or negligence by the Hotel.
In-room safe deposit boxes are provided for guest convenience and are subject to proper use. The Hotel shall not be liable for loss of valuables stored in the safe except in cases of willful misconduct or negligence.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan.
Any disputes shall be subject to the exclusive jurisdiction of the Kyoto District Court (Miyazu Branch) as the court of first instance.
